The conference looks at the different means of developing family and succession law, with particular attention given to the various actors influencing this process. The dynamics of legal development will be traced through lectures on the national laws of selected Islamic countries. Furthermore, three workshops will examine in detail the main actors of legal development, i.e. the legislator, the parties through party autonomy and the judges. The workshops, which will be held simultaneously, will be opened by short presentations to spur the discussion. This format has been chosen to give more room to share views, ideas and experiences.
The workshop on legislation includes topics such as the aims of the legislators, the process of legal reform through statutory law, the obstacles and the different actors influential in the formulation of new laws.
The workshop on party autonomy will focus on the margin of discretion of the parties to form their marital relationship, e.g. the marriage contract and the way it can be used to modify statutory law (financial relationship of the spouses, matrimonial property regimes and their status in contemporary law) including a historical perspective.
The workshop on the judiciary aims at getting an insight into the work of family law judges, their education, their margin of discretion and the difficulties they might encounter. The outcome of the workshops will be presented to and discussed with the plenum. A publication of the proceedings is scheduled for 2014.
